Rory McIlroy’s high-profile divorce could be resolved swiftly after his estranged wife, Erica Stoll, missed a crucial deadline to respond to his petition, DailyMail.com has learned.
Erica, 36, received the divorce papers on May 13 at her Florida home, initiating the state’s standard 20-calendar-day period for her to respond. However, she failed to meet Sunday’s deadline, and an official from the Palm Beach County Clerk’s office confirmed that she has not filed any documents since.
This lapse puts Erica, the mother of the couple’s three-year-old daughter, Poppy, at risk of having the court grant McIlroy a default divorce. If a default is entered, the divorce proceedings will move forward without her input, depriving her of the chance to contest McIlroy’s May 13 petition, which states that their seven-year marriage is “irretrievably broken.”
McIlroy, who was in Kentucky preparing for the PGA Championship when the papers were served, has requested shared parental custody of their daughter and asked the judge to enforce the prenuptial agreement the couple signed before their 2017 wedding.
The summons, delivered to Erica at their Jupiter mansion by Carl Woods, a Palm Beach police officer and process server, warned her: “You have 20 calendar days after this summons is served on you to file a written response to the attached petition with the clerk of this circuit court. A phone call will not protect you. Your written response, including the case number given above and the names of the parties, must be filed if you want the Court to hear your side of the case. If you do not file your response on time, you may lose the case, and your wages, money, and property may thereafter be taken without further warning from the court.”
The documents also urged Erica to consider hiring an attorney, though she currently does not have one assigned to her case.
With Erica’s non-response, the court may proceed to finalize the divorce under McIlroy’s terms, potentially concluding the case without her involvement.
